By accessing or using Bite ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Bite is an AI-powered nutrition tracking application that helps users log and monitor their food intake. The App uses artificial intelligence to analyze text, photos, and voice inputs to provide nutritional information.

3. User Accounts

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

4. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to hack, disrupt, or damage the App
• Upload malicious code or viruses
• Spam, harass, or abuse other users or our systems
• Use automated tools to access the App without permission
• Reverse engineer or copy any part of the App

5. Subscription and Payment

Free Tier: Limited to 5 meals per day, 3 AI calls per day (voice/photo), and 100 total meals.

Premium Tier: Unlimited meal logging and AI features. Subscription fees are charged through the Apple App Store.

Payment Terms:

• All fees are in USD unless otherwise stated
• Subscriptions auto-renew unless canceled
• Refunds handled according to Apple App Store policies
• We may change pricing with 30 days notice
• No refunds for partial subscription periods

6. Content and Intellectual Property

Your Content: You retain ownership of the food logs, photos, and data you submit. By using the App, you grant us a license to use this content solely to provide and improve our services.

Our Content: The App, including its design, code, algorithms, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws.

7. AI-Generated Information

• AI estimates may contain errors or inaccuracies
• Always verify nutritional information for critical dietary needs
• Consult healthcare professionals for medical advice
• We are not liable for decisions made based on AI-generated data

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" without warranties of any kind
• We do not guarantee accuracy of nutritional information
• We are not liable for any health outcomes or dietary decisions
• Our total liability shall not exceed the amount you paid in the past 12 months
• We are not liable for indirect, incidental, or consequential damages

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• You abuse or misuse the service
• Required by law

You may delete your account at any time through the App settings. Upon termination, your data will be deleted according to our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Third-Party Services

The App integrates with third-party services (OpenAI, Google, Supabase). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their actions.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of another party.

15. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
